RAINBOW CHICKEN GOGO VS GOGO COMPETITION

(“Competition”)

TERMS AND CONDITIONS

The promoter is Rainbow Chicken Limited and Point Group Proprietary Limited, which is contracted to promote this Competition (collectively “the Promoter”).

Any persons entering or participating in this Competition (“Participant”) accept and agree that by entering this Competition they have had an opportunity to read and consider these Terms and Conditions and that they are bound by these Terms and Conditions.

1.                 What is the Prize

  1.              The winning Gogo stands a chance of winning:
    1.        R15,000 (fifteen thousand rand) in cash;
    2.        a Food gardening initiative (for a school or community organization nominated by the winning Gogo, to promote fresh ingredients and healthy cooking/eating);
    3.        a branded JoJo tank;
    4.        a custom branded freezer; and
    5.        a scholarship or educational resource for a family member or a local school (as nominated by the winning Gogo), collectively to the value of R130,000 (one hundred and thirty thousand rand) (“Prize 1”).
  2.              The second place Gogo stands a chance of winning R20,000 (twenty thousand rand) in cash (“Prize 2”)
  3.              During the cook off, a pot luck challenge takes place, and the 2 Gogo's select a card from a pot for a chance to win: a R250 voucherat the store of activation, and a R2500 voucher which translates to a cash prize paid via EFT.
  4.              The Prize is not transferrable and may not be exchanged for cash or any other items. The Promoter reserves the right to substitute the Prize/s with any other prize of comparable commercial value.

2.                 Who can participate?

  1.            Any person in South Africa who is 18 (eighteen) years or older may participate in this Competition and nominate their Gogo/Grandmother/Granny/Ouma/Nkhono (“Gogo”).
  2.            Any Gogo in South Africa may to be nominated by a Participant, who is 18 (eighteen) years or older.
  3.            No director, member, partner, employee or agent of, or consultant to the Promoter, any person who directly or indirectly controls or is controlled by the Promoter or any supplier of goods or services in connection with the Promotion, or the spouses, life partners, business partners or immediate family members may enter this Competition.

3.                 How to Participate

  1.            To enter this Competition, Participants must complete the “nominate your Gogo form” on the website https://rainbowgogo.co.za/ or complete the form at selected Wholesalers (view participating wholesalers here https://rainbowgogo.co.za/wholesaler-nomination/)
  1.            Every nominated Gogo will be called by the Promotor and must:
  1.              give consent to be nominated;
  1.              agree to have their photo and the recipes which must include a Rainbow Chicken product submitted via the nomination form to appear on the Promotor’s websites and social media platforms;
  1.              agree to appear in the Taste The Memories ‘Gogo Vs Gogo’ cook off competition between 2 (two) Gogo’s, alongside their family members without seeking remuneration; Gogo’s should be enthusiastic and comfortable engaging with others, including speaking confidently on-camera and being mobile during filming. Sharing their cooking experiences, interacting with the crew and audience, and embracing the fun, laughter, and lively spirit of the competition are key aspects of the event.
  1.              allow for video footage to be taken of Gogo cooking in her family home;
  1.              give consent to appear in at least 3 (three) interviews with the Promotor’s production teams; and
  1.              sign a talent release form alongside their family members.
  1.            Selection Criteria for the Gogos who get to participate in the regional cook-off filming events:

 

  1.              Internal Selection: From the nominations received, the Promotor will conduct an internal selection process to choose the Gogo's who will participate in the regional cook-offs. This selection process will be done by way of a random draw. Three separate regional draws will take place (one for the Western Cape, one for Gauteng and one for KwaZulu-Natal) and 40 Gogos will be shortlisted in total across the three regions.
  1.              Further Vetting: Shortlisted Gogos and their nominators will be contacted via the information provided on the nomination form and invited to a WhatsApp video call whereby an interview will take place. The interview will be an in-camera interview where the Promotor will vet the selected Gogo’s and ascertain responses to shoot day availability, participation enthusiasm by both the Gogo and their nominee, as well as cooking ability level, and ability to communicate.
  1.              Locations: The Competition will take place across three regions: KwaZulu-Natal (KZN), Western Cape (WC), and Gauteng. 4 (four) Gogo's will be selected from each region to compete in the regional cook-offs filmed events. The 4 (four) selected Gogos from each region who were selected following the interview (further vetting process) will participate in the regional cook-off, where the Gogos will prepare the recipes submitted via the nomination form.
  1.              Use of Personal Ingredients: Contestants are permitted to bring and use personal ingredients from home to enhance their dishes. These ingredients should be non-perishable and pre-approved by the competition organizers. The use of personal ingredients is intended to allow contestants to showcase their unique culinary skills and creativity. All ingredients must comply with food safety standards and regulations.

 

  1.              Voting: The regional cook-off events will be judged by general public from the region and/or a panel of food industry influencers or experts (including but not limited to Rainbow Chicken employees or support staff) or a combination of both. Points will be awarded for: taste, heritage flavours, creativity/ingenuity and additional bonus points may be earned for successfully completing ad-hoc cook-off challenges. The judges decision is final and no correspondence will be entered into.

 

  1.              Final Cook-Off: The two Gogo's with this highest cook-off points scored across all regions (KZN, WC, Gauteng) will compete in the final cook-off event. The winner of the final cook-off will be chosen by a selected panel of judges. The final cook off will take place at the Hammersdale Plant, 1 Stanley Methven Road, Hammarsdale, 3701, KwaZulu-Natal.
  1.            No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with all entry instructions.
  1.            A Participant’s entries may be restricted if it is believed their entries are excessive and any future entries and the entrants profile may be blocked until investigated.
  2.            The Promoter reserves the right to disqualify any entry if any act of fraud or dishonesty is suspected, including without limitation, through the manipulation of code or otherwise frequently falsifying data.
  3.            Entries which are unclear, illegible or contain errors will be declared invalid and will not be published to the campaign microsite.
  4.            The Promoter shall not be responsible for any lost, damaged, or delayed entries for any reason whatsoever, and proof of sending will not be accepted as proof of receipt by the Promoter. The Promoter is not liable for any technical failures affecting the participation and/or Prize redemption process of this Competition.
  5.            The Promotor is exempt of any and all responsibility should any injury occur whilst cooking on the show.
  6.       In the event that entry into this Competition is contingent on the Participant entering any website or social media page or application, the Participant hereby acknowledges that any and all costs associated with the required internet connection will not constitute a cost of entering into this Competition and shall be borne solely by the Participant.

4.                 Personal Information

  1.            By entering this Competition, the Participant and the Gogo consents to the collection, use, storage, disclosure, processing, and further processing of his/her personal information (the Participant’s name, ID number, cell phone number, address, personal preferences, and other personal information the Participant provides when entering and participating in this Competition) by the Promoter.

 

  1.            The purposes for processing personal information is to: (i) conduct this Competition; (ii) facilitate the Participant’s participation in this Competition; (iii) communicate with the Participant and send direct marketing communication on Rainbow Chicken and similar products via email and (iv) for market and product research.
  1.            Should the Participant object to the processing of his/her personal information and/or receipt of direct marketing, the Participant should send an email to [email protected]
  2.            By posting any content, images, or comments on any of the Promoter’s public and/or social media platform, a Participant consents to and gives the Promoter a world-wide royalty free licence to reproduce, modify, adapt, and publish such content, images or comments for the purposes of promoting the Promoter’s products and/or services.

5.                 Indemnity

By entering this Competition, the Participant unconditionally and irrevocably indemnifies and holds harmless the Promoter, as well as its holding company, its subsidiaries and any subsidiaries of its holding company, and their successors and assigns, directors, employees, agents or consultants against all and any losses, claims, proceeding, actions, damages, (direct, consequential or otherwise) liability, demands, expenses, legal costs (on an attorney and own client basis) howsoever arising out of, based upon, or in connection with (directly or indirectly) the Participant’s participation in this Competition and the Prize/s.

6.                 Duration

  1.              This Competition runs from 18 September 2024 and closes at 23h59 on 18 October 2024 (“Closing Date”). Any entries received after the Closing Date will not be considered.
  1.              The Promoter reserves the right to reasonably extend, shorten, suspend the time period of this Competition or terminate this Competition for technical, commercial, and/or operational reasons, or for reasons beyond its control. This Competition, Prize and Terms and Conditions may be reasonably amended by the Promoter, at any time during this Competition. In such event, all Participants waive any rights that they may have/purport to have in terms of this Competition and acknowledge that they shall have no recourse against the Promoter whatsoever.

7.                 Logistics and Accommodation

  1.              Duration of Cook-Off: The length of time required for shooting the cook-off, including cooking and interviews, will be determined by how efficiently the tasks are completed. While the goal is to complete all filming within 8 (eight) hours during the day, nominated Gogo's should be prepared to allow for up to 2 (two) days of shooting, if necessary.
  1.              Accommodation: In the event that filming extends beyond 1 (one) day (the anticipated 8 (eight) hours), the Promotor will provide accommodation for only the Gogo's.

 

8.                 Results

  1.              The provisional winners will be selected by a judges’ determination, within 21 (twenty one) working days of the finale cook-off event in early 2025.
  1.              The judges shall consider the following factors in their determination:
  1.                 tasting of the dish prepared;
  1.                 the creative use of heritage flavours;
  1.                 completing additional cook-off tasks or challenges; and
  1.                 Gogo’s community involvement and CSR initiatives.
  1.              The judges’ decision, if applicable under clause 8.1 above, will be final and binding and no correspondence will be entered into.
  1.              The Participants selected as winners of the Prize/s will be notified via telephone or email within 3 (three) days of the date on which the provisional winners are determined. In the event that any provisional winner cannot be successfully contacted or fails to respond to the Promoter within this time, the Promoter reserves the right to select another Participant in substitution. The names of the winners will be published on the Promoter’s Instagram and Facebook pages.
  1.              The Promoter will require the provisional winner/s and/or winners to:
  1.                 provide their name and identity number, and to enable the Promoter to verify the entry;
  1.                 sign an acknowledgment of receipt of the Prize, and indemnity; and
  1.                 where the entry includes the submission of any work eligible for copyright in terms of the Copyright Act No. 98 of 1978, conclude an agreement of assignment whereby any rights which the winner may have in respect of such works are transferred to the Promoter.
  1.              Should the provisional winner/sand/or winners refuse to comply with this rule for any reason then the provisional winner/s and/or winners shall be deemed to have rejected the Prize, and it shall revert to the Promoter.
  1.              The Promoter reserves the right to announce the name of the winner publicly. Any winner may be requested to attend the draw and announcement of the winner, to take part in the Promoter’s publicity campaigns or to allow their photo and likenesses to be used by the Promoter for promotional purposes. Winners are, however, entitled to decline such request.
  1.              Where a winner consents to take part in the Promoter’s publicity campaigns, they will not be entitled to any remuneration for such participation and all materials arising from such participation will be the sole property of the Promoter.

9.                 General

  1.              The Promoter reserves the right to delete any information uploaded by a participant which the Promoter, in its absolute discretion, believes is illegal, obscene, offensive or defamatory, or infringes the intellectual property rights of a third party, or is otherwise inappropriate for a campaign designed for mass audience entertainment.
  1.              Participants warrant that they have full rights to the images and stories that they upload and that the use of the said material shall not constitute a breach of any third party’s copyright or other intellectual property rights.
  1.              Participants agree that by participating in this Competition, they grant permission to the Promoter to take images and/or videos of their participation in this Competition, in any and all media for promotional/marketing purposes with no consideration payable to the Participants.

10.            Disputes

  1.          Should any dispute arise in relation to these Terms and Conditions, the Promoter’s decision will be final, and no correspondence shall be entered into.
